How does mediation work for estate disputes in Queensland?

Parties and their solicitors attend, usually for a single day, in which each party sets out their in a joint session, and then the mediator assists them to work toward terms the parties can sign on the day. Most estate disputes resolve at mediation, which keeps the estate’s assets with the beneficiaries rather than being spent on a hearing. Jennifer sets a clear agenda in advance so the day is used for resolution, not for discovery of the issues. Jennifer ensures that each party understands the uncertainties of a hearing and the benefits of coming to their own resolution but respects that the ultimate decision on settlement remains with the parties.

What is an AMDRAS accredited mediator?

AMDRAS is the Australian Mediator and Dispute Resolution Accreditation Standards, the national framework governing mediator training, practice and ongoing assessment. An accredited mediator has met those standards and is subject to them. Jennifer is AMDRAS-accredited, and brings a specialist’s grounding in equity, trusts and succession to the substance of the dispute as well as the process.

How to remove a trustee in Queensland?

A trustee may be removed under the terms of the trust deed, or by the Supreme Court under the Trusts Act. The Court’s concern is the welfare of the trust and its beneficiaries rather than punishing the trustee, so the evidence needs to be precise about the conduct and its effect. Jennifer advises on the most direct route available on the facts, including a negotiated retirement where that resolves the matter sooner.

What is a breach of trust claim?

A breach of trust claim is brought where a trustee has acted outside the trust’s terms or fallen short of their duties, for example by mixing trust property with their own, favouring one beneficiary, or investing imprudently. Remedies can include an account, compensation to restore the trust fund, and tracing of trust property. These claims turn on careful reconstruction of the trust’s dealings, which is where specialist equity experience is decisive.

What is an informal will in Queensland?

An informal will is a document, or a recording, that records a person’s testamentary intentions without meeting the usual formal signing and witnessing requirements. Under the Succession Act the Court may admit it to probate if satisfied the deceased intended it to operate as their will. Applications of this kind rest on the evidence around the document, so they are worth assessing early and clearly before costs accumulate.

What is a family provision application in Queensland?

A family provision application asks the Court to order further provision from an estate for an eligible person, being a spouse, child or dependant, where adequate provision has not been made for their proper maintenance and support. Strict time limits apply: notice within six months of death and the application within nine months. Jennifer advises applicants and executors alike, and works toward resolution at mediation wherever the facts allow.

How to contest a will in Queensland?

A will can be challenged on its validity, for example for lack of testamentary capacity, undue influence or want of knowledge and approval, or its effect can be challenged through a family provision application. The two routes call for different evidence and different strategy. A considered assessment of the estate, the documents and the medical records at the outset will usually tell you which path is worth pursuing and which is not.
