General Civil Litigation Barrister, Brisbane
Superannuation disputes, debt recovery, real property and boundary matters.
Alongside her specialist equity, trusts and estates practice, Jennifer Sheean takes briefs across the everyday civil disputes instructing solicitors need covered. That includes superannuation death benefit disputes, debt matters, real property and boundary disputes, and guardianship matters at QCAT. Breadth here is a working practice, not a generalist listing.
What This Covers
Scope of work

These matters are run in the Supreme, District and Magistrates Courts of Queensland. Many overlap with her core areas, superannuation death benefits with estates, boundary disputes with equitable remedies, so the specialist grounding still applies.
Why Brief Jennifer
The difference in this area of practice
01
Breadth Without Being Generic
A working barrister across the everyday civil disputes solicitors need covered, not only the specialist niches. The same counsel can take a debt matter and a contested trust.
02
QCAT From Both Sides of the Bench
Jennifer sits as a Sessional Member of QCAT. Can provide experienced advice but cannot appear.
03
Resolution Focus
AMDRAS-accredited mediation to settle trust and estate disputes quietly, with litigation held in reserve rather than assumed.
MATTER TYPES
The disputes most often briefed in this area
These matters arrive from very different places, but they share a common feature: the amount in issue rarely justifies a long-running proceeding, so the early assessment matters more than the appetite for a fight.
Superannuation
A death benefit usually sits outside the estate, so, unless there is a binding death benefit nomination, the fund trustee decides who receives it in accordance with the superannuation trust deed. . Where a nomination is invalid, non-binding or absent, competing claims turn on evidence of dependency at the date of death in accordance with the superannuation trust deed
Boundary disputes
Fencing, retaining walls, dividing boundaries and the encroachments. Some of these disputes can be heard in QCAT and others require the assistance of the court. These issues are best resolved prior to litigation, if possible.
Debt recovery
Recovery proceedings and defended claims, including matters where the debt itself is disputed or the contract behind it is genuinely in issue. Advice on prospects before proceedings are commenced is recommended.
Guardianship
Applications concerning capacity and the appointment of guardians or administrators. Jennifer sits as a Sessional Member of QCAT, which brings a practical view of how the tribunal approaches these matters. It also means she cannot appear on your behalf in QCAT but is available to advise in these matters.
